Shanghai Economic Commission Follow-Through The "Commercial Franchising Operations Method" ("the Method") Promulgated by Ministry of Commerce

With a view to regulate the commercial franchising operations in the city, reinforce the management on franchising activities and maintain the market order, respective bureau has announced this notice to implement the "Method" as follows:

1. Reinforce the management on entering franchising market
Enterprises carry out business activities in the mode of franchise within the administrative region should meet the requirement stipulated in "the Method". Domestic enterprises should register at the business administrative department.

2. Reinforce the management on disclosing information regarding franchising operation
All business administrative bureaus should supervise the franchiser to disclose true and precise information on time as per the stipulation in "the Method" during and before signing the franchising contract.

　　為規範本市商業特許經營行為，加強對特許經營活動的管理，維護市場經濟秩序，特對貫徹執行《管理辦法》的有關工作通知如下：
　　
一、 於加強特許經營市場准入管理
企業在本市行政區域內以特許經營方式從事商業活動，除了應當符合《管理辦法》的有關規定外，內資企業需向工商行政管理部門註冊登記　　
　　
二、關於加強特許經營資訊披露管理
各區（縣）商業行政主管部門要督促特許經營當事人，在簽訂特許經營合同前和特許經營過程中，按照《管理辦法》以書面形式及時、真實、準確披露相關資訊，指導並要求特許人在資訊披露中建立檔案及相關的管理制度。
