Hong
Kong Companies are advised to register trademarks in both Hong Kong
and China simultaneously
In recent years,
Hong Kong companies that tried to lease counters at major department
stores in China are often asked to show the trademark registration
documents to prove their ownership. The department store will even
request the companies to provide the trademark documents registered
in Hong Kong if a product is labeled as "Hong Kong brand".
Hence, Hong Kong companies are advised to register their trademarks
in both China and Hong Kong in order to protect their rights and
interests.
Due to the
huge market potential in China, a number of Hong Kong companies
are attracted to participate in the domestic sales market. These
companies often adopt branding strategies and labeling (as Hong
Kong brand) to capture the market. For the past few years, the China
government has emphasized heavily on the trademark protection and
has tightened the relevant law enforcement procedures. As a result,
many department stores in China requested tenants to provide the
trademark registration document (registered in China) to prove their
trademark ownership. Where a product labeled as "Hong Kong
Brand", the store will further request tenants to provide the
trademark documents registered in Hong Kong in order to avoid trademark
infringement dispute.
In the past,
some of the Hong Kong companies concentrated their businesses in
China but not in Hong Kong market. They have only registered trademarks
in China while fail to do so in Hong Kong simultaneously. As such,
they are often rejected by the major department stores in China
to lease the counters since they fail to provide valid trademark
registration documents (registered in Hong Kong). Hence, hindered
their marketing plans. Some of the companies have tried to register
their trademarks back in Hong Kong but only found that the trademark
has already been registered. Consequently, they have to use another
trademark in Hong Kong while a different one in China that resulting
in inconsistency. As a result, they cannot label the product as
Hong Kong brand if they fail to provide the proof of trademark registration
in Hong Kong. Therefore, the Hong Kong Trade Department Council
(HKTDC) advises Hong Kong companies should take into account of
the importance of trademark registration by as least register the
trademark in both Hong Kong and China concurrently with a view to
avoid any impact on the entire business plan in China.
